Most of the TDPs associated with the Trusts administered by Verus hold that "a finding by a physician after the Effective Date that a claimant’s disease is “consistent with” or “compatible with” asbestosis shall not alone be treated by the Asbestos PI Trust as a diagnosis." On this basis, no diagnosis of an asbestos-related disease rendered after this date will be accepted unless it is rendered by a qualified physician who has performed a physical examination of the injured party; acknowledged a history of asbestos exposure; acknowledged chest x-ray and/or chest CT findings of pleural or parenchymal asbestos-related disease. This would exclude diagnoses based solely on a records review (Expert Report) or chest x-ray review.
