The TDPs associated with most of the Trusts administered by Verus state that and "all diagnoses of Mesothelioma shall be presumed to be based on findings that the disease involves a malignancy. However, the Plan Trust may rebut such presumptions." Verus will request clarification for claims receiving a diagnosis of well-differentiated papillary mesothelioma (WDPM) unless there is a specific reference to the presence of a malignant process as these variants of mesothelioma are known to often be benign or of low malignant potential. Additionally, claims in which there is a diagnosis of mesothelioma and no indication that it is malignant and the injured party's clinical course/longevity argues against a malignant process may be subject to further scrutiny.
