The Statute of Limitations is only preserved when the disease level remains the same between the original claim and the re-filed claim. If the original claim was filed at an 'Unknown' disease level, the original file date was not automatically preserved for the purposes of Statute. Please submit a Deficiency Response and let us know the original claim number and the Disease Level that the claim was intended to be filed as.
